Houston GLBT Caucus Calls Out Council on NDO

In contemporary times, it’s difficult to win any election without endorsements. Short of spending a fortune on TV ads, they are often the best way to get a candidate’s name out to the voters. But as any candidate is well aware, endorsements typically have to be earned through a record of service and a rigorous screening process.

For Houston and Harris County, one of the most important endorsements that a political candidate can earn is that of the Houston GLBT Political Caucus. The Caucus endorsement means additional votes, and has been the difference between victory and defeat in several local races. So it’s no surprise that most of the municipal candidates for office, both Democrat and Republican, seek this most esteemed prize.

Yesterday, the GLBT Caucus redefined the brewing debate over Houston’s coming Human Rights Ordinance. Though Mayor Parker made a firm pledge to pass a Human Rights Ordinance in her recent State of the City speech, the planned legislation, to the disappointment of many in progressive community, does not extend to private employment because it wouldn’t have the votes to pass Council. But judging from the GLBT Caucus’ 2013 candidate questionnaire, those votes should already be locked down. Eleven Council Members promised to support a comprehensive Non-Discrimination Ordinance during the Caucus screening process, and now that organization is calling them out on that promise.

Posted on the group’s Facebook page, the Caucus confirms that Council Members Jerry Davis, Ellen Cohen, Dwight Boykins, Ed Gonzalez, Robert Gallegos, Mike Laster, Larry Green, Steven Costello, David W. Robinson, C. O. Bradford and Jack Christie all pledged public support for a comprehensive Non-Discrimination Ordinance.

Eleven votes (presumably twelve including the Mayor) out of a Sixteen-member Council is certainly enough to pass the ordinance, with more potential votes lining up. Noah M. Horwitz of Texpatriate did some legwork on this, and even spoke to CM Bradford directly for a most interesting response. I called Council Member Michael Kubosh’s office, and here is what a staff member had to say…

“Council Member Kubosh is against discrimination in all forms, and is looking forward to seeing the proposed ordinance.”

Even with this cautious response from a staff member, sources close to Texas Leftist say that Council Member Kubosh would be likely to support a Non-Discrimination Ordinance that extends to private employment. Said source worked with Kubosh on this issue prior to his election to City Council, and has spoken with him recently as well.

Of course there is no record of Kubosh’s stance, as he did not seek the GLBT Caucus endorsement. But for the Council Members that did, they deserve to be held to their word. Some questions still remain here… What about the other side? Who in the Business community is pressuring Council to not pass the ordinance? Why do they want to support discrimination, and more importantly, why is their voice on the issue loud enough to counter the voices of citizens?

Houston Non-Discrimination Ordiance: Updates

Perhaps better than any of her predecessors, Houston Mayor Annise Parker knows that discrimination is a real issue for the LGBT community. She was a Past President of the Houston GLBT Political Caucus, and her activism is remembered from civic protests to consultation in the landmark Lawrence V. Texas case. And of course, the mayor’s recent wedding to her long-time partner is still illegal in her home state, pending further court decisions.

Given this history, it was especially heartening to hear Parker, in her 3rd and final inaugural address as Mayor, pledge that the time has come to pass a comprehensive, LGBT inclusive Non-Discrimination ordinance (AKA Human Rights Ordinance) in Houston.

Other Houstonians say that it’s time as well. Texans Together Education Fund, an organization founded to increase civic engagement in underserved communities, has started a petition to get the ordinance passed, and whose members are actively lobbying to bring it forth to City Council. Unlike years past, Non-Discrimination has now mobilized Houston’s progressive community to the point where it will impossible for municipal government to ignore. And of course, Houston has a nearby example with San Antonio’s recent NDO, led by Mayor Julian Castro.

But it appears that even the planned ordinance for Houston will not include *direct* discrimination protections for those working in the private sector (which of course is the majority of the workforce). Here’s what Parker had to say on Houston Matters earlier this week…

Craig Cohen: When can we expect a comprehensive Non-Discrimination Ordinance that protects all Houstonians regardless of sexual orientation or gender identity, and will such an ordinance protect those employed in the Private Sector?

Mayor Parker: I hope to have it passed by the end of May. It will affect the Private Sector in as much as if they do business with the City of Houston. It will affect the Private Sector if they operate public accommodations or multi-family housing. But the first draft I’m working on does not apply to the Private Sector otherwise.

Why can’t this first version of the ordinance include private employment? In short, the answer is simple politics. Sources say the Houston ordinance will lose votes on Council if it affects private employers. It’s true that any step is a step forward, especially in these times of heightened contention in politics. But if a Council Member wants to allow discrimination to continue, they deserve to be put on record with a vote. Instead of protecting them, Parker and her administration should let them deal with the Progressive community’s ire. Texas Leftist cannot confirm at this time which persons are against equal protection, but if that information is ever revealed, it will surely be passed along via this blog. As for now, we’ll wait to see what develops this May.

HCRP Sues Houston over Same-Sex Spousal Benefits

This surprising piece of news came from the Houston Chronicle late yesterday…

Harris County Republicans, led by the county’s GOP chairman, sued the City of Houston Tuesday over Mayor Annise Parker’s extension of health and life insurance benefits to all spouses of legally married employees, including same-sex couples in November.

“This is one of the most egregious acts by an elected official I’ve ever seen,” said Jared Woodfill, chairman the Harris County Republican party. Woodfill, is the lead lawyer on the lawsuit. “They just decided to, unilaterally, as a lame duck, thumb their nose at the will of the people and just spit on the U.S. Constitution.”

Woodfill said state District Judge Lisa Millard signed a temporary restraining order late Tuesday, putting the new policy on hold until the matter goes before a judge on Jan. 6.

The lawsuit, filed late Tuesday in state District court, alleges that the mechanism that Parker used to enact benefits for same-sex couples violates the Houston’s city charter, the state Defense of Marriage Act and the Texas Constitution.

Attorneys for the city said the lawsuit will likely be thrown out because the two men who filed it do not appear to have legal standing.

Lest we forget, this is Houston we’re talking about. In Texas? Sure… but we happen to be the 4th largest city in the United States, and in the 3rd largest County. Yet by filing this suit, the Harris County Republican Party… an organization which has openly LGBT members, have proven themselves to be nothing more than a bunch of anti-gay, back-water bigots. Heading into the 2014 elections, HCRP has decided to put their stamp firmly against LGBT equality.

Besides the shock factor, there’s another salient point to make. As Texpatriate points out, there is a rather unsightly problem with this particular ruling. For those that may not be aware, judges in the state of Texas are not only elected, but they are allowed to run with a partisan affiliation. Judge Millard is not only an assumed Conservative, but she is a card-carrying member of the Harris County Republican Party, having both donated to the organization and received support from them as well. Given that HCRP originated the lawsuit, is she doing the party’s bidding by ruling in their favor? I’m no legal scholar, but this alone seems to present a problem for Jared Woodfill and the County GOP. And by problem, I mean a likely countersuit.

Houston City Council PASSES Payday Lending Reforms

Today Houston saw yet another huge ordinance brought forward, in what many are referring to as Mayor Parker’s post-election “Progressive cram”. Like college kids studying for the most vociferous of finals, the Houston City Council passed major regulations on Credit Access Businesses, or issuers of Payday and Auto Title loans. The ordinance proved to be one of the year’s most contentious issues, and CM Christie even attempted a last-minute amendment that would’ve essentially gutted the whole ordinance. It would scrap the requirement to pay a portion of the principal with each payment, and increase the amount of income used to calculate the loan. These issues form the purpose for the ordinance because it gives borrowers a pathway to break the cycle of debt for the loans. The amendment failed 11 votes to 6.

After much discussion, the Payday Lending ordinance passed by a vote of 15 to 2, with only outgoing Council Members Brown and Rodriguez voting against it. This brings Houston in line with other major cities across Texas have already passed payday reforms. But as Texas’ largest city, Houston’s passage will allow the reforms to have a significant impact.

The heart of the new regulations is as follows…

a) Creation of a new database that catalogs (and presumably monitors) all credit access businesses.

b) Loan amount cannot exceed 20 percent of gross monthly income for a payday loan. For an auto title loan, the amount borrowed must be the lesser of either 3 percent of the borrowers annual income, or 70 percent of the automobile retail value.

c) Loans must be paid off in a maximum of 4 installments, and each payment must reduce the loan principle by at least 25 percent.

d) Distribution of consumer credit counseling materials to all borrowers who seek to renew their payday or auto title loan.

The ordinance joins prominent legislation to combat wage theft, and an executive order extending employee benefits to same-sex spouses… all enacted after Parker’s reelection on November 5th.

“Something must be done; something should be done,” Councilman Andrew Burks said. “Our Legislature, they had the ball and dropped it. I don’t like this, but I have to vote for it because … this is the only thing on the table, and it does do something.”

Councilwoman Wanda Adams, who said her office has helped seniors get back cars that had been repossessed after they defaulted on title loans, praised the outcome.

“I’m so proud to know we are taking a stand in protecting our constituents throughout our community,” Adams said. “I think this is something right.”

Yet more evidence that Mayor Annise Parker’s final term promises to be an exciting one for Progressive Texans. It was also a fitting final meeting for Wanda Adams, one of the Mayor’s strongest allies, as she concludes her tenure at City Council. Payday lending reform was one of the last major issues she wanted to tackle as a Council Member. Adams moves on to the HISD Board of Trustees.

Houston: City Employees Granted Full Benefits for Same-Sex Spouses

Today is a big day for Houston’s LGBT community… an emotional day as well. Directly from the Mayor’s Office, here’s the press release…

Mayor Annise Parker today announced that the city will begin offering benefits to all legally married spouses of city employees. This will apply to same-sex couples who have been married in a state where same-sex marriage is legal. The mayor’s decision is based on a city legal department interpretation of recent U.S. Supreme Court decisions and other relevant case law from the around the country.

A 2001 voter-approved City Charter amendment has previously been relied upon as the basis for prohibiting the granting of same-sex benefits. However, the amendment specifically permits benefits to be provided to “legal spouses” of employees. After a careful review of recent case law, the city legal department believes continued application of the charter amendment so as to deny same-sex spousal benefits would be unlawful because it treats employees differently on the basis of sexual orientation.

“Based on the right to equal protection under the law, it is unconstitutional for the city to continue to deny benefits to the same-sex spouses of our employees who are legally married,” said Mayor Parker. “This change is not only the legal thing to do, it is the right, just and fair thing to do.”

The city of Houston is following actions already taken by several federal agencies, including the Internal Revenue Service, which announced in August that all legally married same-sex couples will be recognized as married for federal tax purposes, even if those couples reside in states that do not recognize same-sex marriage.”

As a result of this policy change, same-sex spouses of city employees will now be eligible for the same health care and life insurance benefits previously offered only to heterosexual married couples. It is unclear at this time as to how many employees will take advantage of the change because there is no way to know how many have legally recognized same-sex marriages. The new policy will not extend to domestic partners; it applies only to legally married couples.

The move notes some significant progress for Texas’ largest city, and provides a great example of something other municipalities in Conservative states can do to aid legally married same-sex couples. Under the current charter amendment passed in 2001, Houston is still unable to offer domestic partner benefits to unmarried same-sex couples. Houston

This is a proud moment for the Parker administration… something expected, but maybe not so soon after her reelection. I take it as a signal that she is serious on the advancement of equality for Houston. The issue’s bottom line is all about fairness. At yesterday’s Press Conference, Mike Morris of the Houston Chronicle asked an important question regarding the state-level Defense of Marrige Act…

Morris: “What would you say to a critic who might view this as your administration choosing not to enforce provisions [of state law]?”

Parker: “I’ll read you the exact language in the City Charter.

‘Except as required by state or federal law, The City of Houston shall not provide employment benefits, including health care, to persons other than employees, their legal spouses, or dependent children…’ It’s very clear… employees, legal spouses and their dependent children. The plain language [of who can and cannot be covered] is in the charter.

Morris: “Except as required by state law.”

Parker: “State or federal law, and federal law trumps state law.”

As our state’s Conservative leaders continue to hope pray that LGBT equality will go away, Houston continues to make progress towards a more equal society for it’s citizens.

In the wake of this important step, another fact deserves to be discussed. He may not have expected yesterday’s announcement, but I can guarantee you that fellow blogger Charles Kuffner of Off the Kuff had something to do with it. Through interviews with 35 Houston municipal candidates, including 10 currently elected officials, Kuffner was consistent in putting the candidates on record for their stance about domestic partner benefits. Thanks to his tireless work, this and other equality issues were kept at the forefront of the 2013 elections.

Parker Makes Complete Streets a Houston Priority

Mayor Annise Parker Announces Visionary Complete Streets Policy for Houston

At the site of Texas’ first certified GreenRoads projects in Midtown, Mayor Annise Parker today unveiled a transformative new approach for Houston streets that will accommodate the needs of all users, not just those behind the wheel. The mayor’s Complete Streets and Transportation Plan is meant to provide safe, accessible and convenient use by motorists, public transit riders, pedestrians, people of all abilities and bicyclists. The new policy, detailed in a draft executive order from the mayor, will be achieved over time as improvements to existing roadways and redevelopment occur.

“This executive order is a major first step forward,” said Mayor Parker. “Many groups have worked hard to get us to this point, including The Complete Streets Coalition, Scenic Houston, AARP and BikeHouston. I am thankful for their input and steadfast commitment. Houston is a city that embraces its diversity. This Complete Streets policy applies the same approach to our mobility system by meeting the diverse needs of all Houstonians while also creating more accessible and attractive connections to residential areas, parks, businesses, restaurants, schools and employment centers.

The Complete Streets and Transportation Plan recognizes that all streets are different. The function of the road, current and projected adjacent land use and travel demands, availability of right-of-way, community input and the level of vehicular, pedestrian and bicycle traffic must all be considered in decisions regarding enhancements. The ultimate goal, where appropriate, is walkable and bike-friendly neighborhoods with amenities such as trees and landscaping, public art and street furniture.

“As we work to build a healthier community, it is more important than ever to reimagine our approach to streets, sidewalks, pedestrian crossings, public transit, bike trails and lanes,” said Mayor Parker.

Mayor Parker intends to sign the executive order following a City Council briefing on the plan. Houston is joining other cities that are already utilizing a Complete Streets approach including Chicago, Baltimore, San Antonio, San Diego, Sacramento, Seattle, Portland, San Francisco and New Orleans as well as the U.S. Department of Transportation and numerous state transportation agencies.

The Plan will build upon and utilize tools such as the city’s Mobility Planning already underway. It will create new definitions found in the city’s Major Thoroughfare and Freeway Plan Policy Statement and the Infrastructure Design Manual. The city’s Rebuild Houston program will also ensure that all future roadway construction utilizes the principals contained in the mayor’s Complete Streets Executive Order.

The City of Houston’s Planning and Development Department, Public Works and Engineering Department and METRO will be responsible for administration of the plan. There will be annual reporting to City Council to ensure transparency and accountability.

Houston’s transportation infrastructure spans 640 square miles and consists of 6,000 center lane miles of streets, 1,100,000 traffic signs, 2,450 signalized LED intersections, 1,600 school zone flashers, 180,000 streetlights and 1,800 freeway lights.

As someone who frequently rides a bicycle on Houston’s streets, I can attest that this is sorely needed. Some Houstonians may be skeptical of the need for such an “expensive investment”, but to the naysayers I issue a challenge… Go for a walk on a major thoroughfare like Westheimer or Richmond. Walk the sidewalk, or bike along the far lane. Then try that same activity on the Greenroads projects of Bagby or Pierce. Once you spend some time outside of the car and actually experience these places in human contact, the need for complete streets is obvious. 

The order also fulfills part of the promises made regarding Council’s passage of significant changes to the city’s development code, better known as Chapter 42. The complete streets initiative will prove to be a critical need as Houston becomes a denser city, and more people seek a range of transportation options other than their cars. In my opinion, complete streets are safer, healthier and better for all. It’s to see these projects starting on Pierce and Bagby… and even better that the Mayor recognizes these projects shouldn’t be the exception, but must become the norm.

In the Fifteenth installment of the 2013 Texas Leftist Candidate Questionnaire, we hear from Hon. Annise D. Parker, current Mayor of Houston, and running for her third and final term.

TL: What is your name, as it will appear on the ballot?

AP: Annise D. Parker

TL: Are you a current or former elected official? If so what office(s)?

AP: I am currently Mayor of Houston.

TL: As a political candidate, you clearly care about what happens in certain levels of government. In your own words, why is government important?

AP: In order for human beings to live in concert with one another, you have to have government. It’s a mechanism for deciding what you do as a community. I have been frustrated that, as a country, we seem to be losing that focus on community in favor of a more consumer-driven focus on individuals wanting to pay only for the services they use. It is my hope that people will think more about how we can re-engage as a community and re-engage with local government in service of community. Government should be run efficiently and effectively. I have applied many approaches I’ve learned in the business world to achieve that. But ultimately, government is a service organization, not a business. It really is about making our communities stronger.

TL: If elected, what is your top priority in office for the upcoming term? Describe how you plan to accomplish it.

AP: Continue to create jobs. We are seeing very good results from Hire Houston First, a program I started to give preference to firms that hire local workers when they apply for city contracts. I will continue the reforms we started in the Office of Business Opportunity – the former Affirmative Action Department. We expanded our overall city-contracting goal for small, minority, woman-owned businesses to 34 percent. We’ve helped secure more than $25 million in private funds for small business loans. We’ve provided incentives that have attracted more than $2.2 billion in economic development for the city. And we’ve worked with labor unions to provide apprenticeship programs on city-funded projects.

Continue to reduce crime and improve public safety. Since I became mayor, Houston’s overall crime rate is down more than 8 percent. We’ve modernized public safety, protected police officers from layoffs and increased the number of officers on the street. We’ve revamped the police radio and technology system, bulldozed 2,000 crack houses and dangerous abandoned buildings, opened our new Sobering Center so that police officers can focus more of their time on fighting crime, made substantial progress on creating an independent crime lab (separated from the police department), put a plan in place to eliminate the backlog of sexual assault kits and more.

Use resources available to the city to support our children’s education. Although the city is not charged with education in the traditional sense (setting the curriculum, hiring teachers, etc.) I’ve made sure that our resources are working to strengthen schools and help schoolchildren. In August we distributed 25,000 backpacks full of school supplies to children in need. I appointed a Chief Education Officer to coordinate city initiatives around education. We’re working to coordinate infrastructure projects near schools and keep our kids safe when they go to school. We’re building new libraries and funding after-school programs. We’re working with partner organizations to help children stay in school and gain the necessary skills to find good jobs when they graduate.

TL: With the exception of city government and some other select businesses, Houstonians can still be fired for being lesbian, gay, bisexual or transgender because we do not have a comprehensive non-discrimination ordinance for general employment. This lags behind other Texas cities such as Dallas, Austin, and Ft. Worth. Do you support a comprehensive non-discrimination ordinance for the city of Houston? If not, please explain why. If so, please explain how you would work to pass such a measure.

AP: I absolutely believe we should pass an anti-discrimination ordinance. Houstonians deserve those protections. Passing the ordinance will require agreement from all councilmembers, and when we have the support necessary we can move forward.

TL: There have been an alarming number of complaints filed against officers in the Houston Police Department, accused of unwarranted police brutality towards citizens. A disproportionate amount of this violence occurs in minority communities, and in the vast majority of these cases, officers have gone unpunished. As a result, these incidents cause a cycle of mistrust between Houstonians and the very officers sworn to protect them. What can you do to increase oversight of the Houston Police Department, and help ensure that these incidents do not continue?

AP: The Chief of Police, his Command Staff and I take very seriously any allegation of police brutality. That’s why it is simpler and easier than it has ever been before to bring a complaint against an officer. We revised the complaint process, removing language on the forms that threatened perjury charges for unproven allegations. We made complaint forms available for the first time through community organizations like NAACP, Urban League and LULAC. We created the Independent Police Oversight Board, whose community panelists review allegations of police abuse, use of force and all discharges of weapons. We have begun to deploy body cameras among patrol officers, with the goal of having all officers wear them as soon as financially possible. We are purchasing new TASERS that limit the duration of the electrical charge administered. And we have dealt swiftly and decisively in removing officers who have violated the rights of citizens.

TL: What makes you the best candidate for this office?

AP: Houston is leading the nation in job creation and the vast majority of ways that people rank cities. I’m running because I believe we can do even better. During my two terms as Mayor, Houston’s city government is borrowing less and doing more on a pay-as-you-go basis. We’ve created a dedicated fund for street repairs and flood prevention. We’ve secured funding for new libraries and laid the foundation for a parks and trails system that most cities can only dream of. We put more police officers on the street and are working to make our city safer. We’re demolishing crack houses and dangerous abandoned apartment complexes – and we’re modernizing our police and fire stations. I want to help the best city in America get even better.

TL: When not on the campaign trail, how do you like to spend your free time?

AP: Between my job as mayor and my campaign, free time is a real luxury! I spend as much time at home with my family as I can – and I relax by reading and working in the garden tending my cacti, succulents and orchids.
